Local Nuisance

Local nuisance is described as "any adverse impact on the amenity value of an area, which unreasonably interferes with, or is likely to unreasonably interfere with, the enjoyment of that area by people in that area."

The Local Nuisance & Litter Control Act 2016 was implemented by the State Government to provide an increased focus on Local Government management of local nuisance, litter and illegal dumping matters across South Australia.

Under the Act, Councils inherit an array of functions and responsibilities previously undertaken by the Environmental Protection Authority (EPA). These responsibilities will include having to investigate complaints about:

  • Noise
  • Odours
  • Smoke, fumes or dust
  • Animals
  • Insanitary conditions on-premises
  • Unsightly conditions on-premises, caused by human activity or lack of activity

What is not a local nuisance?

The Act specifies what can constitute a local nuisance and anything outside of this, Council can’t deal with, here are a few examples:

People noise including music and voices from domestic premises – SAPOL phone: 131 444

Any activity from liquor licensed premises – Liquor Licensing Authority investigate such complaints phone: 131 882

Noise from vehicles (other than vehicles operating within, or entering or leaving, business premises) SAPOL - phone: 131 444

Activities controlled by an Environment Protection Authority SA licence – EPA phone: 8204 2004

How to deal with a Local Nuisance

If you're bothered by a local nuisance, there are steps you can take to resolve the issue.

Speak to the person

In the first instance, speak to the person or group causing the problem. In many instances, they may not even realise that what they are doing is a nuisance. Often a simple conversation makes the party aware of the issue and can encourage them to take action.

Reporting a nuisance

If you are unsuccessful in resolving the issue through conversation, we can support you and take action if necessary.
